FocusVault Terms of Use

These Terms of Use ("Terms") are an agreement between you and the developer of FocusVault ("FocusVault", "we", "us"). By downloading, accessing, or using the FocusVault app, you agree to these Terms. If you do not agree, do not use the app.
1. The service
FocusVault is a focus, habit, and drive-time companion app. It includes focus timers, habit tracking, a distraction shield, driving-focus features, and audio content (news-style podcast episodes, briefings, stories, book discussions, music, and text-to-speech reading), much of which is generated by artificial intelligence. You must be at least 13 years old to use FocusVault.
2. Driving safety, your sole responsibility
Read this section carefully. It is the most important one.
- FocusVault's drive features are designed to be hands-free and eyes-free: the whole purpose of drive audio is to let you keep driving and listen without distracted driving. The intended way to use them is by voice and by audio, with the phone put away.
- We discourage looking at FocusVault, or any app, while driving. No screen, feature, or button in this app is an invitation to look at or handle your phone while a vehicle is moving.
- Due to hardware limitations, we cannot control how you use your phone. A phone cannot reliably determine who is driving, cannot prevent a driver from touching it, and cannot control personal habits. FocusVault's detection, reminders, and hands-free design are conveniences, not safety systems, and they can be wrong, delayed, or unavailable.
- Operating the app while driving is solely your responsibility. You are always solely responsible for safe operation of your vehicle, for keeping your attention on the road, and for complying with all traffic laws and all laws on device use while driving in your jurisdiction.
- If any interaction with the app requires looking at or touching your phone, do it only while safely parked.
- Assumption of risk. To the maximum extent permitted by law, you assume all risk arising from your decision to use a phone in or around a vehicle, and we are not liable for any compensation, accident, injury, death, fine, citation, or property damage arising from or related to use of the app while driving or in a vehicle.
3. AI-generated content
- Audio episodes, briefings, summaries, stories, coaching notes, and similar content in FocusVault are generated by AI. AI content can be incomplete, outdated, or wrong.
- All content is provided for general information and entertainment only. It is not professional advice of any kind, including financial, investment, medical, health, or legal advice. Do not make decisions based on it without verifying with a qualified source.
- News-style episodes are AI-written summaries based on headlines and descriptions published by third-party outlets, with attribution shown in the app. FocusVault is not affiliated with, sponsored by, or endorsed by any news outlet, publisher, or author referenced in the app.
4. Content you submit (Listen to Anything and uploads)
When you submit a link, article, document, or other content for summarization or read-aloud:
- You confirm that you have lawful access to that content and the right to use it this way, and that your use is personal and non-commercial.
- You are solely responsible for the content you submit. We process it transiently to produce your summary or audio and do not store it, share it, or use it to train models.
- We may refuse or stop processing any submission at our discretion.
5. Third-party content and links
The app shows links to third-party websites (for example, source links for news stories). If you follow a link, you leave FocusVault and the third party's own terms and policies apply. We are not responsible or liable for third-party websites, apps, or content, or for anything that results from you clicking through to them. Links are provided for attribution and convenience only, and should be opened only while safely parked, never while driving.
6. Subscriptions and purchases
- Premium features are sold as auto-renewing subscriptions through Apple. Price and term are shown in the app before purchase.
- Payment is charged to your Apple account. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel in your Apple ID subscription settings.
- Purchases, billing, and refunds are handled by Apple under Apple's terms. We never see your payment details.
7. Acceptable use
You agree not to: use the app for any unlawful purpose; attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the app or its servers; resell or redistribute app content; or use the app's audio or summaries to build a competing content service.
8. Intellectual property
The app, its design, and content we generate are owned by us or our licensors. We grant you a personal, non-transferable, revocable license to use the app for personal, non-commercial purposes. If you send us feedback, we may use it without obligation to you.
9. Copyright complaints
If you believe content available through FocusVault infringes your copyright, email us at the contact address below with the details (the content, where it appears, and your claim of rights). We review all such notices and will remove or disable access to infringing content where appropriate.
10. Disclaimer of warranties
The app is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, non-infringement, accuracy, or uninterrupted availability. Features that depend on device sensors, Apple services, or network connectivity (including drive detection and audio generation) may fail, be delayed, or be unavailable.
11. Limitation of liability
To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising out of or related to the app, however caused, even if advised of the possibility.
- Without limiting Section 2, we are not liable for any harm, loss, or damage arising from use of the app while driving, from reliance on app content, or from third-party content or websites reached through the app.
- Our total liability for all claims relating to the app is limited to the greater of (a) the amount you paid us through the app in the 12 months before the claim, or (b) fifty US dollars ($50).
Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing in these Terms excludes liability that cannot be excluded by law.
12. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from content you submit, your violation of these Terms, your violation of law (including traffic and device use laws), or your misuse of the app.
13. Disputes, arbitration, and class action waiver
- Informal resolution first. Before filing a claim, contact us at the email below and give us 30 days to try to resolve the issue.
- Binding arbitration. Any dispute arising out of these Terms or the app that is not resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court.
- Class action waiver. Disputes will be resolved only on an individual basis. You and we each waive any right to participate in a class action, class arbitration, or representative proceeding.
- Opt-out. You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration.
- These Terms are governed by the laws of the United States and of the US state in which the developer resides, without regard to conflict-of-law rules.
14. Apple-specific terms
Because the app is distributed through Apple's App Store:
- These Terms are between you and us only, not with Apple. Apple has no obligation to provide maintenance, support, warranty, or refunds for the app beyond what Apple's own terms require, and is not responsible for addressing any claim by you or a third party relating to the app, including product liability claims, consumer protection claims, and claims that the app infringes intellectual property rights.
- You represent that you are not located in a country subject to a US government embargo or designated a "terrorist supporting" country, and are not on any US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- Our contact for questions, complaints, and support is the email address at the end of these Terms.
15. Termination
You can stop using the app and delete your account at any time. We may suspend or terminate access for violation of these Terms. Sections 2, 3, 5, and 8 through 14 survive termination.
16. Changes to these Terms
We may update these Terms. Material changes will be noted in App Store release notes and by updating the effective date above. Continued use after a change means you accept the updated Terms.
17. General
If any provision of these Terms is found unenforceable, the rest remain in effect. These Terms and the privacy policy are the entire agreement between you and us regarding the app.
